Situation of Venezuela Within MERCOSUR

Today, the Foreign Ministers of the signatory Member States of the Treaty of Asunción, Susana Malcorra for the Argentine Republic, José Serra for the Federative Republic of Brazil, Eladio Loizaga for the Republic of Paraguay, and Rodolfo Nin Novoa for the Oriental Republic of Uruguay, notified the Foreign Minister of the Bolivarian Republic of Venezuela, Delcy Rodríguez Gómez, that the Bolivarian Republic of Venezuela’s rights inherent in the status of Member State of MERCOSUR have been suspended.

 

This measure, which is based on the Vienna Convention on the Law of Treaties, both as a general legal principle and as a customary rule, was decided by the Foreign Ministers of the signatory Member States of the Treaty of Asunción in the “Joint Declaration on the Functioning of MERCOSUR and the Protocol of Accession of the Bolivarian Republic of Venezuela,” adopted on 13 September 2016.

 

Indeed, it was established in said document that the status of compliance with the obligations assumed by the Bolivarian Republic of Venezuela in its Protocol of Accession to MERCOSUR would be assessed again on 1 December 2016, and that continued non-compliance as from the date mentioned above would result in the suspension of the rights inherent in the status of Member State of MERCOSUR.

 

The status of compliance with the obligations assumed by Venezuela was assessed yesterday, and non-compliance was verified.

 

It should be noted that Venezuela had four years to incorporate current MERCOSUR regulations and it was given an additional period to honour its obligations, which expired on 1 December 2016, and that the adopted measure will remain in force until the signatory Member States of the Treaty of Asunción agree with Venezuela on the conditions for the restoration of the latter’s exercise of rights as a Member State.
